The court concluded that the way in which the service elicited necessary information from users relating to their roommate preferences (by owning dropdowns specifying gender, existence of kids, and sexual orientation), and the method in which it utilized that information in creating roommate matches (by reducing profiles that did not match user technical specs), that the service was an "facts information supplier" and as a result liable for the discrimination statements.
